NEW YORK – Retailers will see fewer customers visits wholesale clothing during the critical back-to-school season, a research firm forecast Tuesday, but it expects shoppers will spend more than last year.

ShopperTrak, which is based in Chicago,Juicy Couture t-shirts, said it expects customer counts to dip 1.4 percent,MLB Jerseys, while total retail revenue will increase 3.5 percent for August compared with the same month in 2009. That compares with a 7.7 percent drop in traffic and a 4.9 percent decline in sales last August.

ShopperTrak measures measures retail revenue and traffic at more than 50,000 outlets.

"The data we’ve received from thousands of retail clients wholesale clothing throughout the year shows traffic levels have been slightly down since just before the holidays, but spending has remained positive during this time, which points to value-driven consumers spending more during less trips to the mall," said Bill Martin, co-founder of ShopperTrak.

Lohan spent 84 minutes in jail in 2007 after she pleaded guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.

The plea came after a pair of high-profile arrests earlier that year. Lohan was sentenced to three years of probation but had to ask for a yearlong extension in October after she failed to complete her alcohol-education courses on time.

"I’m not taking this as a joke," said Lohan, who had an obscenity printed on her left middle finger. "It’s my life. It’s my career I’ve worked for my entire life."

On Wednesday, a judge delayed trial in a lawsuit filed wholesale clothing against Lohan until she completes her jail sentence. The case had been scheduled to begin July 27. Both sides have listed Lohan as a potential witness.

Prosecutor Danette Meyers argued Tuesday that Lohan wasn’t taking the charges or her punishment seriously and urged jail time for the actress.

"We are proud to have this remarkable artist work on our film," he said.

A deposition likely to include questions about Lohan’s drug use at the time of her 2007 arrest will also be postponed.

Revel said she found the starlet’s apology insincere, comparing it to "somebody who cheats and thinks it isn’t cheating if she doesn’t get caught."

Lohan’s attorney, Shawn Chapman Holley, claimed that the actress had adhered to the spirit of the law, if not the letter.

Kerry Wallum, a producer with Lucky Films, said Lohan was in negotiations for a role in the upcoming Willie Nelson movie, "The Dry Gulch Kid," and that the production would wait for her if she wanted the part.

Lohan’s sentence may also prevent her from further promoting her new fashion line, 6126. The first items from the 280-piece collection are shipping out to department stores nationwide this month.

"She has gotten it together," Holley said. "She changed her conduct and is now in compliance with the court’s overall order."

Lohan burst into tears upon hearing the terms of her punishment.

Lohan’s agent, Nick Styne, declined to comment. Her manager,Abercrombie jackets, Jason Weinberg, did not respond to an e-mail request for comment.

The punishment levied by Superior Court Judge Marsha Revel will keep Lohan from promoting "Machete," the Robert Rodriguez action film due in theaters in September. 20th Century Fox, which is releasing the film, had no comment.

A tearful Lohan pleaded with the judge before the sentencing, saying she did the best she could to juggle jobs and the court-ordered classes and really tried to comply with the terms of her probation.

Revel also chastised Lohan for missing a court hearing in May while at the Cannes Film Festival and repeatedly skipping out on court-mandated, alcohol-education classes. She said Lohan lied about using drugs and tried to blame others for the two driving offenses involved in the original charges.

Lohan’s jail and rehab sentence will also delay production on "Inferno: A Linda Lovelace Story," in which the 24-year-old actress plays the starring role of the famed porn star.

Lohan was instrumental in the line’s design and marketing plans and is featured in its promotional materials. Her business partner, Kristi Kaylor, did not respond to phone and e-mail messages seeking comment.

The actress was sentenced Tuesday to 90 days in jail and 90 days in a residential substance-abuse program for violating her probation, stemming from two separate 2007 cases of driving under the influence of cocaine and alcohol. She is to surrender and begin wholesale clothing her jail sentence July 20. Rehab will follow.

"You have not caught her attention," Meyers told the judge. "I appreciate the tears, but I don’t think you’ve got it."

"We’re behind her," he said. "We’ll wait until all of this blows over."

Lohan is being sued by Tracie Rice, a passenger in a vehicle Lohan was following in a pre-dawn pursuit that ended in a Santa Monica parking lot. Also suing the actress are two men who were passengers in the vehicle Lohan allegedly commandeered that night,Abercrombie shorts, and another man who claimed he had his foot run over.

Lohan may serve less than her 90-day sentence, thanks to jail overcrowding and a state program that credits inmates for good behavior, said Los Angeles Sheriff’s Department spokesman Steve Whitmore. Nonviolent female misdemeanor offenders typically serve about 25 percent of their sentences, he said.

Judge Revel cited Lohan’s conduct after the chase at Tuesday’s probation hearing, noting Lohan initially told police someone else was driving.

Writer-director Matthew Wilder said after the probation ruling that he and his crew remain "100 percent behind Lindsay."

"We have a crisis, and the consequences of not having cooperation from (mortgage) servicers is . . . felt by this entire economy," Warren said. "We need a wholesale clothing program with far more urgency and some real teeth in it."

WASHINGTON – Government watchdogs told a Senate panel Wednesday that the Obama administration’s effort to help homeowners avoid foreclosure isn’t working and that the Treasury Department has failed to fix the program.

Barofsky said Treasury is giving mortgage companies too much leeway to decide which homeowners will qualify for a program to reduce the principal balance of their mortgages.

The bailout has provided up to $50 billion for the mortgage modification programs. So far,Seven, about $248 million in bailout money has been spent on the program.

Special inspector general for the financial bailouts Neil Barofsky said the program has not "put an appreciable dent in foreclosure filings," during a Senate Finance Committee hearing on the $700 billion bank bailout. He also said the Treasury Department has wholesale clothing ignored earlier demands that it set clearer goals for the program.

The homeownership program aims to reduce mortgage payments for millions of homeowners who can’t afford their monthly bills. Recent data suggest it has helped about 400,000 households avoid foreclosure. About 530,000 have fallen out of the program.

President Barack Obama was preparing Wednesday to sign into law the most sweeping rewrite of financial regulations since the 1930s. The law includes changes aimed at reassuring Republicans, who worry the bailout fund could become permanent.

More foreclosures could force down the price of homes and further hurt the already-ailing housing industry.

Elizabeth Warren, who chairs a separate Congressional Oversight Panel on the bailouts, said Treasury’s failure to act more quickly could be hurting the recovery.

The size of the fund is reduced to $475 billion from $700 billion. Money that has been repaid must be used to repay the national debt, rather than expanding other programs. And the overhaul blocks Treasury from using the money to create new programs.

Also appearing at the hearing is a leader of the Government Accountability Office.

Most of the financial bailout programs have ended as the financial system regained its footing. Treasury lent out a total of $385 billion from the $700 billion fund. As of June 30, about $198 billion had been repaid, according to the independent Government Accountability Office.

Treasury also has collected $25 billion in fees and interest payments from companies that received money.

The program relies on voluntary cooperation from mortgage companies, Warren said. She said many of the mortgage debt collectors make more money when they foreclose than they do when helping homeowners.

Shares of Deutsche Bank fell $1.36, or 2.2 percent,Ralph Lauren, to $60.53 in afternoon trading on the New York Stock Exchange.

FINRA said delinquency rates are material to investors who invest in mortgage-backed securities because future returns are affected by borrowers who default on their loan payments.

Deutsche Bank Securities neither admitted nor denied the charges, regulators said.

"We have cooperated with FINRA throughout its wholesale clothing investigation and are pleased to have resolved this matter," said Renee Calabro, a spokeswoman for Deutsche Bank.

Regulators also said Deutsche Bank didn’t establish a system to monitor the reporting of such data.

WASHINGTON – Deutsche Bank Securities Inc. has been fined $7.5 million for allegedly misrepresenting delinquency data related to the issuance of certain risky mortgage-backed securities.

Additionally,Diesel, the Financial Industry Regulatory Authority, an independent regulator of U.S. securities firms, said the firm failed to correct third-party vendors and servicers who were underreporting historical delinquency rates on 16 other securities issued in 2007.

Regulators said Wednesday that the company misrepresented wholesale clothing and underreported the percentages of mortgages that were delinquent in information sent to investors for six securities issued in 2006.
